Definitions and law

The contract is the document or documents that set out these conditions and all other details about your agreement with us.

“We” and “Us” “Owner” and “Our” mean the seller/supplier of the goods

“You” or “Your” or “Hirer” means the hirer of the goods

The “Goods” mean all goods to be hired by us to you

The “Recipient” means the person, firm, company, corporation or public authority to whom the goods are delivered, when it is not you. These conditions exclude any terms and conditions you may have put forward, except where we have agreed to any amendments or other conditions in writing.

General Conditions

 

All items remain the property of The Candy Cart Company.

Due to the weight of the equipment, venues must have a parking space available.

Please note it is the hirers responsibility to cater for guest numbers, knowingly under catering for the amount of guests may result in the hire period finishing early.

The venue must provide a sturdy table,  with tablecloth and access to an electrical point for the Machines . We may require more than one table if hiring multiple items.

The candy floss machine should be located in a well ventilated area due to the heat from the sugar potentially affecting fire sensors, it is the hirers responsibility to arrange this with the venue and The Candy Cart Company cannot be held responsible if the candy floss machine needs to be turned off due to issues.

Food Allergies

We shall not be held responsible for food allergies of the Hirer or their guests. All chocolate, dipping items, sweets and other foodstuffs may contain traces of nut or other allergens. It is the responsibility of the Hirer to inform their guests that traces of nut or other allergens may be present.

Prices includes set up at your venue.

Please note that once in place the candy cart & Hire Goods Fun Food Stations cannot be moved.

We shall make our best efforts to supply you with the goods requested, but we reserve the right to supply you with similar goods.

Prices quoted are for one days hire only, excluding collection unless a special agreement has been arranged prior to the event between the Owner and the Hirer. Machine hire which is normally at  10pm/10.30pm other services collection the next day. Fitting at the venue will normally be on the morning of the event, unless another date is agreed on booking. Subsequent days will be charged at a daily rate unless a special agreement has been arranged prior to the event between the Owner and the Hirer

Booking

We require a payment of £50/£75 to reserve your booking, this deposit will act as your security deposit, All deposits are non refundable Please note that all dates will only be provisionally booked until this has been paid or we receive payment in full. Also note that in the event of your cancellation, this fee cannot be returned.

Payment

We require payment in full no less than six - four weeks before the event.

Deposits Are Non Refundable.

If for any unforeseen reason we are forced to cancel your order then you will be notified by email and all deposits, payments made will be refunded in full.

 

Last minute orders

We are able to cater for last minute orders; we class last minute orders as any orders placed with less than six to four weeks before the event date.  Last minute bookings are subject to availability and we require payment in full plus payment of bond.

 

Prices

We reserve the right to change our product prices without notice. Once the holding deposit has paid the total order value will be honoured and will not be subject to change. Quotes given by email or telephone may be subject to change on price or availability until the holding deposit is paid.

Hire

The hire period is 24 hours ordinarily, unless otherwise stated. We offer free delivery within a 25 mile radius of the KA12 Delivery charges will be added to quotes if the venue is outside of our delivery radius, these charges will be worked out once we have a location/venue.

 

Chocolate fountain hire

In the unlikely event that the fountain should breakdown or fail to operate as a fountain, the system will still allow the guests .

 to dip food into the fountain bowl filled with chocolate.

In the Unlikely event should any Equipment Breakdown we will not be held liable .

Samples meetings

We welcome samples meeting which allows you to see our items first hand, our portfolio of work,  we also welcome you to see or try samples of sweets, Products available when you book with our Services, Samples meetings are arranged by request only.

 

Changes to your order

We appreciate that you may need to change your order due to a number of reasons, should this happen we require you to notify us within a reasonable time period, all alterations will be subject to availability.

 

Loss Damage

The following replacement charges for items are as follows;

Fun Food Stations pic mix/carts/chocolate fountain - £200+ depending on assessment of damage

Lights – £10.00 each

Glassware - £10-£20 each

Props- £5-£15 each

Missing items or damaged items will be charged at the full replacement value, we will not accept any substitute replacements. Should you be charged for any damage you may request by email, phone or written communication that the goods be returned to you, this must be within 14 days of being informed by us of the charges. If you wish to have the damaged goods returned to you this will be done so at your own cost. Should we not hear from you within the 14 days then the named items will be disposed of.

Please note that if a venue cannot locate hired items and this results in us having to make a return journey for collection, the cost of this travel will be charged at £1 per mile.

6.1 Hired equipment will be set up in one location only as agreed on arrival and will not be moved once unloaded.

6.2 The company reserve the right to refuse delivery if the venue or site is deemed to be unsuitable by our delivery personnel or if the client has failed to notify the company of any delivery obstructions such as stairs or excessive loading distances from our vehicle to the installation site. In such a case no refund will be given and the full hire fee will be due.

6.3 The client is responsible for ensuring that suitable security and crowd control measures are in place prior to start of event.

6.4 The company reserves the right to cease operation and remove hired equipment from site if at any time a representative of the company feels that guests or clients conduct endangers the safety of the guests, clients, themselves or the safety of the hired equipment. At no time will any level of abuse against our staff be tolerated. In all such cases no refund will be given and full contracted fees will be due to the company.

 

Liability

The Candy Cart Company accepts no liability for any injuries or damage to any persons or property arising from any items under hire.

 

Food Allergies

We shall not be held responsible for food allergies of the Hirer or their guests. Items may contain traces of nuts or other allergens. It is the responsibility of the Hirer to inform their guests that traces of nut or other allergens may be present.

 

Insurance

It is your responsibility to ensure that the hired items are covered by that of your own insurance or the venues insurance with regards to public liability risks. The Candy Cart Company will not be liable for any claims made by any persons for injuries or damages caused by or in conjunction with the hired items, including our fitting service.

 

Cancellation Terms 

 

If for whatever reason you have to Cancel your booking at any stage between making your deposit and your agreed event date you will not Recieve your initial deposit back as this is not refundable or transferable . Additional fee charges will apply . All Cancellations should be made via Email .

 

If you move your date or venue of your event we will try and do our best to accommodate your request . but this may be proven difficult at peak times of the year . If however your request cannot be  accommodated then the relevant cancellation Fees will apply. 

 

Cancellation and addmentment fees - 

 

Within 8 weeks of  the Event - 50% of Total Cost 

 

Within 6 weeks of Event - 80% of Total Cost 

 

Within 4 weeks of event - 100% of Total Cost 

 

This excludes non Refundable Deposit Sum . 

 

Any Payments to be Made via Client that the Client  are within a period of a Payment from a cancelation  been made via The Candy Cart Company . Please Email the Appropriate Transaction Details For payments to made within 14 working Days of Email/writing to confirm your event cancellation . 

 

Complaints
In the event of a complaint, the hirer should attempt to rectify the problem with the company staff on the event date at the venue/location. Where this is deemed not possible complaints should then be made in writing or email candycartcompany@aol.co.uk to the company within 48 hours of the event date. Complaints will be thoroughly investigated and a response provided to the Hirer within 14 working days.

 

Behaviour
The hirer is held entirely responsible for their and their guest's behaviour. Company staff will not entertain abusive hires and guests and will cease to perform during instances of threatening behaviour. The Company reserves the right to end all services early, without prior notice or refund, in the interests of company staff safety
